COMECE: ‘Abortus is geen EU-competentie’

Het Europees Parlement overschrijdt zijn competenties waar het om abortus gaat.

Dat zegt de Commissie van Europese Bisschoppenconferenties (COMECE) in een verklaring naar aanleiding van een stemming dinsdag over “seksuele en reproductieve gezondheid en de daarmee verbonden rechten”. Daaronder valt ook abortus, terwijl de EU op dat terrein geen juridische beslissingscompetentie heeft, aldus de COMECE in een verklaring.

Het Europees Parlement boog zich dinsdag over een voorstel dat voorziet in algehele legalisering van abortus en invoering van een verplichte “taboevrije” interactieve seksuele voorlichting voor alle schoolkinderen.

De COMECE wijst erop dat abortus in veel EU-landen illegaal is. “Met het oog op de menselijke waardigheid en in de overtuiging van een absoluut recht op leven is abortus wettelijk verboden. De Europese Unie moet dit respecteren en mag dit niet proberen te omzeilen door beslissingen te nemen die buiten zijn competentie vallen.”

Ook EP-lid Peter van Dalen (ChristenUnie) keerde zich tegen het voorstel en diende met enkele anderen een alternatieve motie in.

“Nationale overheden moeten waar mogelijk zwangere vrouwen en jonge moeders ondersteunen. Bescherming van het ongeboren leven vanaf het prille begin moet daarbij uitgangspunt zijn. Laat Europa hier alsjeblieft buiten blijven. Abortus is in geen enkel verdrag erkend als mensenrecht en ik heb niet de behoefte dat te veranderen”, Aldus Van Dalen.

“Seksualiteit en voortplanting zijn gevoelige en intieme zaken. Ik heb er geen enkele behoefte aan dat Europa zich daar ook nog mee moet gaan bemoeien.”


ComeceDo not be misled: abortion is not a EU competence

In the context of the Vote today at the European Parliament of an own initiative Report on “Sexual and Reproductive Health and Rights” which includes abortion, COMECE recalls that the EU has no competence in regard to this matter. EU citizens should not be misled.

Article 168 § 7 of the Treaty on the Functioning of the EU states that the ”Union action shall respect the responsibilities of the Member States for the definition of their health policy and for the organisation and delivery of health services and medical care. The responsibilities of the Member States shall include the management of health services and medical care and the allocation of the resources assigned to them.’’

In many EU member states abortion is illegal. Out of consideration for human dignity and the conviction that right to life is absolute, abortion is banned by law. The EU should respect and not interfere with decisions that do not fall within its sphere of competence.

COMECE deplores the fact that the Report put to vote today may confuse EU citizens on the remit of the Union competences. With elections to the European Parliament on the horizon, EU citizens need to be reassured that the EU will stick with its legal competences.
